These Terms of Use (“Terms”) are between you and Faith Systems, LLC, an Ohio limited liability company, and its affiliates (collectively, “Faith Systems,” “we,” “us,” or “our”). These Terms govern your use of the ChurchRaise platform (churchraise.com, churchraise.ai) and the e-Church Bulletins service (e-churchbulletins.com), collectively referred to as the “Services.”
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you are using the Services on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.
2. Service Description
ChurchRaise is a church management software-as-a-service (SaaS) platform that provides tools for:
- People management (contacts, families, groups, check-in, custom fields)
- Online giving (donations, campaigns, fundraisers, pledges, giving statements)
- Communications (email newsletters, SMS messaging, autoresponders)
- Digital bulletins and bulletin advertising
- Website building and hosting
- Events and calendar management
- Volunteer management and facility scheduling
- Forms and connect cards
- Online store and memberships
- Service planning and sermon management
- AI-powered assistants for content creation, design, strategy, and administration
- Media library and AI image generation
- QR code management (Quick Tap)
- Background checks and safety screening
Features may vary based on your subscription plan. We reserve the right to modify, add, or discontinue features at any time with reasonable notice.
3. Accounts & Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent
- Organization administrators are responsible for managing user roles and permissions within their organization
4. Subscriptions & Billing
- ChurchRaise offers both free and paid subscription tiers
- Paid subscriptions are billed through Stripe on a recurring basis (monthly or annually)
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days’ notice
- Refunds are handled on a case-by-case basis at our discretion
5. AI Features
The Services include AI-powered features. By using them, you acknowledge and agree that:
- AI outputs are assistive, not authoritative. AI-generated content (text, images, recommendations) should be reviewed by a human before publishing, sending, or acting upon
- No guarantee of accuracy. AI features may produce inaccurate, incomplete, or inappropriate content. You are solely responsible for reviewing and approving AI-generated outputs
- No guarantee of availability. AI features depend on third-party providers (OpenAI, Google) and may be temporarily unavailable due to provider outages, rate limits, or content policy restrictions
- Your prompts are processed by third parties. When you use AI features, your prompts and conversation context are sent to OpenAI and/or Google for processing. See our Privacy Policy for details
- Content responsibility is yours. You are responsible for all content you publish using AI-generated outputs, including compliance with copyright, defamation, and other applicable laws
- Provider terms apply. AI-generated images and content may be subject to usage restrictions imposed by the underlying AI providers. You agree not to use AI-generated content in ways that violate those providers’ terms
6. AI Credits
- AI features are billed using a pre-paid credit system
- New organizations receive an initial grant of free credits
- Additional credits may be purchased in packs; purchased credits never expire
- Subscribers receive monthly credits that expire at the end of each billing cycle
- Credits are non-refundable and non-transferable
- Credit consumption rates are based on the AI model and operation used, and may be adjusted with notice
7. Donation & Payment Processing
Church organizations may use the Services to accept donations and payments from their members and supporters. By using these features:
- The church organization is the merchant of record for all donations and payments collected through its pages
- Faith Systems facilitates payment processing through Stripe and/or Square but is not a party to the transaction between the church and its donors
- Church organizations are responsible for their own tax-exempt status, donation receipting, and compliance with applicable tax and fundraising laws
- Faith Systems does not charge platform fees on donations (payment processor fees from Stripe/Square still apply)
- Giving statements and tax receipts generated by the platform are provided as a convenience; churches are responsible for verifying their accuracy
8. Your Content & Data
- You retain ownership. Church organizations retain all rights to their data, including contacts, content, media, website content, and other materials uploaded to the Services
- License to us. You grant Faith Systems a limited, non-exclusive, worldwide license to host, store, process, display, and transmit your content solely for the purpose of providing the Services
- Public content. Content you make publicly available (church websites, giving pages, event pages, group hubs, fundraiser pages, volunteer sign-ups, store pages, membership portals) is your responsibility. You represent that you have the right to publish such content
- Data export. You may export your data at any time through available export features or by contacting support
- Backup. While we maintain regular backups, you are responsible for maintaining your own copies of critical data
9. Acceptable Use
You agree to use the Services only for lawful purposes related to church and nonprofit operations. You may not:
- Use the Services for any illegal, fraudulent, or malicious purpose
- Upload or distribute content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorized access to other accounts or systems
- Use automated tools (bots, scrapers, spiders) to access the Services without written permission
- Interfere with or disrupt the Services or their underlying infrastructure
- Use AI features to generate content that violates applicable laws or AI provider terms of service
- Resell, sublicense, or provide the Services to third parties without authorization
- Impersonate another person or entity
- Circumvent or attempt to circumvent security measures
We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion.
10. Communications Compliance
Church organizations using our email and SMS features are responsible for compliance with applicable communications laws, including:
- CAN-SPAM Act — All bulk email must include a functioning unsubscribe mechanism, accurate sender information, and a valid physical address
- TCPA — SMS messages require prior express consent from recipients. Do not send unsolicited text messages
- GDPR — If communicating with EU/EEA residents, obtain appropriate consent and honor data subject requests
The Services provide built-in unsubscribe handling and opt-out mechanisms. You must not circumvent or disable these features.
11. Data Processing
When church organizations use the Services to manage member data:
- The church organization is the data controller for its member and donor data
- Faith Systems acts as a data processor, processing data on the church’s behalf and according to its instructions
- Church organizations are responsible for maintaining their own privacy policies and obtaining necessary consents from their members
- We process your data only as necessary to provide the Services and as described in our Privacy Policy
12. Intellectual Property
The Services, including all software, design, text, graphics, logos, and other content created by Faith Systems, are protected by intellectual property laws and remain the property of Faith Systems. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms.
You may not copy, modify, distribute, sell, or create derivative works based on our proprietary content without our prior written consent.
13. Third-Party Services
The Services integrate with third-party providers (Stripe, Square, Twilio, OpenAI, Google, MinistrySafe, Unsplash, and others). Your use of these integrations may be subject to those providers’ terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.
14. Warranty Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI-GENERATED CONTENT IS PROVIDED WITHOUT WARRANTY AS TO ACCURACY, COMPLETENESS, OR SUITABILITY FOR ANY PURPOSE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAITH SYSTEMS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
16. Indemnification
You agree to defend, indemnify, and hold harmless Faith Systems and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Content you upload, publish, or distribute through the Services
- Your use of AI-generated content
17. Termination
- You may stop using the Services and close your account at any time by contacting support
- We may suspend or terminate your access at any time for violation of these Terms, with or without notice
- Upon termination, your right to use the Services ceases immediately
- We will make your data available for export for a reasonable period (30 days) after termination, after which it may be deleted
- Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Ohio.
You agree that any cause of action arising out of or related to the Services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
19. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Faith Systems regarding the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
